Flagler reiterates Department of Business and Professional Regulation Emergency Order to suspend on-site consumption of alcoholic beverages at bars

June 26, 2020 – Flagler reiterates Department of Business and Professional Regulation Emergency Order 2020-09 to suspend on-site consumption of alcoholic beverages at businesses that derive more than 50% of gross revenue from the sale of alcoholic beverages.

Halsey Beshears, Secretary of Florida’s Department of Business and Professional Regulation said in the order that the decision was made because of the increase in positive COVID-19 test results, especially among younger individuals “suspected to have originated from visits to bars, pubs, or nightclubs” and may have disregarded the restrictions of  Governor Ron DeSantis’ Phase 2 of the state’s “Safe. Smart. Step-by-Step.” plan for recovery from COVID-19, under Executive Order 20-139.

 “It’s an unfortunate step backwards,” said Emergency Management Director Jonathan Lord. “This is necessary for public safety. We have been trying to appeal to everyone’s strong sense of community to protect each other from the virus by frequent 20-second handwashing, wearing cloth face coverings, social distancing, and avoiding crowds.”

Bars will be permitted to sell alcoholic beverages in sealed containers for off-premises consumption in accordance with Executive Order 20-71, sections 1 and 2.

Restaurants, under Executive Order 20-139, can continue to serve alcohol on site, for seated patrons provided they derive less than 50% gross revenues from its sale.


All residents and businesses are reminded to abide by Executive and Emergency Orders, and follow Florida Department of Health and CDC guidance.

Additionally, those who are sick and/or told to self-isolate are to: remain at home unless seeking medical care, cover coughs and sneezes, wear a facemask around others, and disinfect touched surfaces daily.
